Terms and Conditions

The Company (The Tree Co. and its authorised representatives), on acceptance by the Client of the quotation (the Contract) supplied (verbal or written) agrees to work in a competent manner with regards to all horticultural work undertaken. All work shall be carried out in accordance with current statutory laws, regulations and directives.

Quotations and reports on findings: Quotations are valid for up to 30 days unless otherwise agreed by the Company, unless a material change to the specified works or change to site dynamics occurs. It is the responsibility of the client to notify the company of material changes to the specifications or site dynamics prior to the agreed start date for works. Material alterations such as site access or other complications occurring after the time of quotation may result in further charges or in some circumstance the severance of part or the whole of the agreement.

On receipt of the client's acceptance, the Company will agree a timescale for the execution of works - This may be altered where such factors impact on the timescale. Examples of such factors are adverse weather events or those beyond the Company's control.

Those works which do not fall within a termed contractual agreement will not commence until both the Company and Client have agreed a new contract.

To ensure the Company does not cause unreasonable disturbance or damage, the Company may require the client to move such items as is practical, away from the works zone(s). The Client shall take such measures to ensure that the location of any items of personal property that cannot be moved, e.g. garden structures or heavy furniture, is identified to the Company before any work starts so that damage may be avoided once work has begun. Portable items should be removed by the client before any work begins.

Tree works quotations are based on an assessment of the tree(s) from the ground only unless otherwise specified and the Client should be aware that in all cases, all lengths and heights that are quoted for are approximate.

TPO's and Conservation area work: If the Company puts in an application to work on a TPO (Tree Preservation Order) or Conservation Area tree at the Client's request, and the Client chooses to use someone other than the Company to carry out the works applied for, the Company will invoice the Client £50 (50 pounds) to cover the administrative costs of the application.

Underground / overhead services: The client is to ensure that they make known and provide such utility plans or drawing to the Company of any subterranean or overhead cables to allow safe execution of the required works.

Variation of agreement / works: Where required and where further agreement is made between the Company and the Client, a quotation and an extension of works can be agreed by both parties to allow for further works.

Work may be suspended due to discovery of protected habitat or wildlife, such as nesting birds, bats etc.

If matters arise that could not reasonably be known to the Estimator (and where this has a cost implication), these will be drawn to the Client's attention, and any further costs for additional works or plant machinery (e.g. crane hire) would be discussed and only charged to the client at the cost incurred by the Company.

Private covenant and protections in Law: It is incumbent on the client to make the Company aware of any private covenant, or legal restriction to work such as tree preservation or conservation area status. Where this is not done, no liability shall attach itself to the Company for any such breach. All relevant permissions should be obtained by the Client prior to the commencement of works.

Payment Terms: On conclusion of works, the Company will invoice the client for the due amount. Payment of the full invoiced amount is required immediately or within 14 days of the date of invoice if agreed in advance by the Company. The Company reserves the right to charge interest on accounts overdue beyond this time at a rate of 5% of the invoice amount per week. If the Client cancels the work at any time within four weeks of the agreed start date, 50% of the agreed amount will be due. Cancellations made longer than four in advance will incur no charge.

These terms and conditions are subject to change from time to time without notice and at our sole discretion. We will notify the Client of amendments to these terms prior to a Contract being agreed.
